Welcome to Chapter 15. Today we are walking into the room where the lawyers live, and you are going to discover that it is much less terrifying than rumor suggests. By the end of this chapter you will be able to read a privacy notice the way a sommelier reads a wine label, explain to a CFO why moving the European data warehouse to Ohio is a problem, and tell a product manager — without raising your voice — why "we will just collect everything and figure out what to do with it later" is the most expensive sentence in their backlog. Privacy and compliance are where engineering meets policy, and the engineers who can fluently speak both dialects become extraordinarily hard to replace. Let's collect the vocabulary.
Privacy Is Not Security (and Both Are Not Compliance)¶
The first move in becoming literate in this area is to untangle three words that get used interchangeably and mean different things. Security is about preventing unauthorized access to data. Privacy is about constraining authorized access — even when you have legitimate possession of someone's data, what may you actually do with it? Compliance is about being able to prove — to a regulator, an auditor, or a court — that you handled the data the way the rules required.
You can have perfect security and terrible privacy: a fortress that legally collects far more personal information than it has any business knowing. You can have excellent privacy intent and zero compliance: doing the right thing but unable to demonstrate it on paper, which in regulator-land is roughly equivalent to not having done it. And you can have airtight compliance documentation around a system that suffers a breach next Tuesday. The mature IS organization treats all three as distinct disciplines that share infrastructure but answer different questions.
Why does this matter for an IS career? Because every system you will design, buy, integrate, or retire touches at least one of the regulatory regimes we are about to introduce, and several of them apply at the same time. A hospital's patient portal is governed simultaneously by HIPAA (because it contains health information), by PCI-DSS (because it accepts credit cards for copays), by state privacy laws like CCPA (because it has California users), and by SOX if the hospital is a publicly traded health system. Pretending only one of those exists is a great way to ship a system that is technically excellent and legally radioactive.
GDPR: The Regulation That Set the Tone¶
The GDPR — the General Data Protection Regulation — is the European Union law that came into force in May 2018 and quietly became the global default for how thoughtful organizations think about personal data. GDPR is broad: it protects "personal data" (any information relating to an identified or identifiable natural person) of any individual in the EU or EEA, regardless of where the processing organization is located. A startup in Singapore that sells software to a customer in Frankfurt is on the hook for GDPR compliance for that customer's data. The extraterritorial reach is the feature, not a bug.
GDPR organizes its requirements around two principal roles: the data controller (the organization that decides why and how personal data is processed) and the data processor (a vendor or service provider that processes data on the controller's behalf). It then layers on a set of principles, lawful bases, individual rights, and operational obligations that every controller and processor must satisfy.
Penalties under GDPR are the reason boardrooms started caring. The maximum fine is the greater of €20 million or 4% of global annual revenue — global, not European, revenue — which makes a single violation an existential issue for most companies. Regulators have been willing to use the upper end: Amazon was fined €746 million in 2021, Meta €1.2 billion in 2023. The chilling effect has rippled into every product organization on Earth that has any European users, which is essentially all of them.
Lawful Basis: You Need a Reason¶
GDPR's most foundational principle is Lawful Basis: an organization may not process personal data unless it can name one of six specific legal grounds for doing so. "Because it would be useful for our marketing team" is not on the list. The six lawful bases are:
- Consent — the data subject has freely given specific, informed, unambiguous agreement to the processing.
- Contract — processing is necessary to perform a contract with the data subject (or to take steps at their request before entering one).
- Legal obligation — processing is required by law (e.g., reporting wages to a tax authority).
- Vital interests — processing is necessary to protect someone's life (a narrow basis, mostly used in emergencies).
- Public task — processing is necessary for a public-interest task or official authority (mostly used by governments).
- Legitimate interests — processing is necessary for a legitimate business interest that is not overridden by the rights of the data subject.
Each basis has different rules and constraints, and an organization must choose and document the basis before processing begins. Switching bases mid-stream — "we collected this under consent but we will keep using it under legitimate interests after the user withdraws consent" — is exactly the kind of move that ends up in a fine.
Purpose Limitation and Data Minimization¶
Two principles that flow directly from lawful basis are Purpose Limitation and Data Minimization. Purpose limitation says that personal data collected for one specified purpose may not be reused for an incompatible purpose without a fresh basis. If you collected an email address to deliver a digital receipt, you may not silently add it to a marketing list. Data minimization says you may collect only what is adequate, relevant, and limited to what is necessary for the stated purpose. The phone number field on the signup form needs a justification — not the other way around.
Of all the privacy controls in this chapter, data minimization is the highest-leverage. A company that does not collect a piece of data does not have to secure it, encrypt it, document it, retain it, audit it, delete it, transfer it across borders under legal scaffolding, defend it in litigation, or report it as breached when something goes wrong. The cheapest piece of personal data is the one you decided not to collect. Most privacy disasters are stories of data that nobody really needed but everyone kept "just in case." Data minimization is the structural fix.
Consent Management and Data Subject Rights¶
When consent is the chosen lawful basis, GDPR demands real consent — freely given, specific, informed, unambiguous, and as easy to withdraw as it is to give. Consent Management is the operational discipline (and increasingly an entire category of software) of capturing, storing, and honoring those consents. A consent management platform records exactly which consents each user gave, when, for which purposes, under which version of the privacy notice — and it enforces those consents downstream so analytics tags don't fire for a user who declined them.
Consent is also where the cookie banner became the most-clicked UI element in human history. The footgun here is consent fatigue: when every site demands consent for everything, users stop reading and click "Accept All" reflexively. This is a classic Goodhart-style unintended consequence — the regulation that was meant to produce informed consent often produces exhausted consent instead. The regulators have responded by tightening the rules on dark patterns ("Reject All" must be as prominent as "Accept All") and a few jurisdictions are exploring browser-level signals like Global Privacy Control. The structural fix isn't another banner; it's collecting less data so consent is needed for fewer things.
GDPR also grants every data subject a set of enforceable Data Subject Rights — concrete things they can demand of any organization that holds their personal data. The core rights are:
- Right of access — "Tell me what data you have about me."
- Right to rectification — "Correct the data that is wrong."
- Right to erasure (the "right to be forgotten") — "Delete my data."
- Right to restrict processing — "Stop processing this while we sort it out."
- Right to data portability — "Give me my data in a machine-readable format I can take elsewhere."
- Right to object — "Stop processing for marketing or other contested purposes."
- Rights related to automated decision-making — "I want a human in the loop on consequential decisions about me."
Two of these deserve special attention because they have outsized engineering implications.
The Right to Erasure sounds simple — "delete the user's data" — and is one of the hardest things a real production system has to do. The data is in the operational database, the analytics warehouse, the data lake, the search index, the message bus archive, the encrypted backups, the third-party CRM, the logs, and the reports a vice president downloaded as a CSV last March. A genuine erasure operation has to traverse every one of those, and the system has to be designed so that traversal is possible. Most pre-GDPR architectures were built on the implicit assumption that data, once written, would live forever. Retrofitting deletion into them is a multi-year program.
Data Portability is the right to receive one's personal data "in a structured, commonly used, machine-readable format" and to transmit it to another controller without hindrance. The intent is to break vendor lock-in and let users move from one social network or fitness app to another with their history intact. The engineering implication is that systems must be able to export the user's data in a defined schema — typically JSON or CSV — and to do so on demand, not on a quarterly batch cycle.

CCPA and CPRA: California's Answer¶
The United States has no comprehensive federal privacy law, so the action has been at the state level — and California, as usual, set the pace. The CCPA (California Consumer Privacy Act, in force since January 2020) and its successor CPRA (California Privacy Rights Act, in force since January 2023) together create a privacy regime that rhymes with GDPR without being identical to it.
The differences matter. CCPA/CPRA applies only to for-profit businesses meeting certain thresholds (revenue, volume of California residents, share of revenue from selling personal information), where GDPR applies to virtually any organization. CCPA/CPRA's key innovation is the right to opt out of the sale or sharing of personal information — a category that does not have a clean GDPR analog and that has caused real reckoning in the ad-tech industry. CPRA also created a dedicated regulator, the California Privacy Protection Agency, modeled loosely on the EU's data protection authorities.
A dozen other US states have followed with their own privacy laws — Virginia, Colorado, Connecticut, Utah, Texas, and a growing list — each with slightly different definitions, thresholds, and rights. The result is a patchwork that has made "privacy by US-state-residency" a real and unwelcome feature of modern data architectures. The structural fix many companies have settled on is to adopt the strictest applicable standard globally, treat every user as if they had GDPR rights, and stop trying to maintain twelve different code paths.
HIPAA: Health Information Has Its Own Rules¶
The HIPAA statute — the Health Insurance Portability and Accountability Act of 1996, with its Privacy Rule and Security Rule promulgated in the early 2000s — governs how protected health information (PHI) is handled by covered entities (healthcare providers, health plans, healthcare clearinghouses) and their business associates (vendors processing PHI on a covered entity's behalf). HIPAA predates GDPR by two decades and shows it: the structure is more sectoral, the language is more bureaucratic, and the enforcement landscape is dominated by the Office for Civil Rights at the Department of Health and Human Services.
What HIPAA actually requires can be summarized in three buckets. The Privacy Rule restricts the uses and disclosures of PHI: you may use it for treatment, payment, and healthcare operations without authorization, but most other uses require the patient's explicit authorization. The Security Rule mandates administrative, physical, and technical safeguards — risk analyses, access controls, audit logs, encryption, contingency plans. The Breach Notification Rule requires that breaches of unsecured PHI be reported to affected individuals, to HHS, and (for breaches over 500 individuals) to the media within 60 days.
HIPAA has aged into an interesting shape. The original statute did not anticipate cloud-based EHRs, telehealth, mobile patient portals, AI-driven diagnostic tools, or genomic data. The regulators have stretched HIPAA over those new use cases through guidance documents and enforcement actions, with mixed success. A core IS lesson here is that regulations always lag the technology, and the gap is where engineering judgment is required: the bare letter of HIPAA may permit something that is clearly contrary to its spirit. Equipped IS professionals read both.
SOX: When Financial Reporting Becomes an IS Problem¶
The SOX statute — Sarbanes-Oxley, passed in 2002 in the wake of the Enron and WorldCom accounting scandals — is technically a financial-reporting law, but it has enormous implications for IS. The relevant section for our purposes is Section 404, which requires that publicly traded companies maintain and assess the effectiveness of internal controls over financial reporting. The catch: most of those controls are implemented in software. Therefore, every system that touches the financial statements — ERPs, billing systems, revenue databases, expense systems, payroll — falls inside the scope of SOX, and the IS team becomes responsible for proving that those systems' controls work.
In practice, SOX compliance shows up in the IS shop as an annual audit cycle in which the team must demonstrate, with documentation, that change management is enforced (no developer pushes to production without ticketing and approval), that access controls are enforced (segregation of duties, periodic access reviews), that data integrity is preserved (audit logs, backup verification), and that incident response is mature. Auditors come in, sample, test, and produce a finding letter that the CFO must read carefully.
SOX does not protect personal privacy directly — it protects the integrity of financial data — but the discipline it imposes on systems-of-record looks remarkably like the discipline GDPR imposes on personal-data systems. An IS team that already runs a SOX-compliant ERP has 70% of the muscle memory it needs to run a GDPR-compliant CRM.
PCI-DSS: The Card Brands' Private Regulation¶
The PCI-DSS standard — Payment Card Industry Data Security Standard, currently at version 4.0 — is unique in this chapter because it is not a law. It is a contractual standard imposed by the major card brands (Visa, Mastercard, American Express, Discover, JCB) on every organization that stores, processes, or transmits cardholder data. The enforcement mechanism is private: violators can be fined or, in extreme cases, lose the ability to accept card payments, which for most consumer businesses is an existential punishment greater than most regulatory fines.
PCI-DSS organizes its requirements into twelve high-level controls grouped under six objectives — build and maintain a secure network, protect cardholder data, maintain a vulnerability management program, implement strong access controls, regularly monitor and test networks, maintain an information security policy. The controls are prescriptive in a way most regulations are not: specific cryptographic algorithms, specific log retention periods, specific frequencies for vulnerability scans. Compliance is assessed annually by a Qualified Security Assessor (QSA) for larger merchants, and via self-assessment questionnaires for smaller ones.
The systems-thinking lesson of PCI-DSS is that scope is everything. Every server, network segment, and database that touches a card number is "in scope" for PCI assessment, and the cost of compliance scales roughly linearly with scope. The single highest-leverage architectural decision in payment processing is de-scoping — using a tokenization service or a hosted payment page so that the card number never touches your infrastructure at all. The systems that handle the fewest cards are the systems easiest to comply with.

Pause here
The reflex of a junior IS engineer is to ask, "Which regulation applies to my system?" The reflex of a senior one is to ask, "Which regulations apply to my system?" — and to expect the answer to be three or four. Modern IS rarely lives under a single regime. A telehealth platform that bills via credit card and operates in California, Germany, and Texas is simultaneously governed by HIPAA, PCI-DSS, GDPR, CCPA, and the Texas Data Privacy and Security Act. The art of the senior compliance posture is to find the intersection of the strictest requirements and build to that, rather than maintaining five parallel compliance programs that no human can mentally reconcile.
Privacy by Design: Bake It In, Don't Bolt It On¶
Privacy by Design (PbD) is the architectural philosophy that says privacy must be considered from the first day of a system's design, not added as an afterthought during pre-launch security review. The framework was codified in the 1990s by Ann Cavoukian, then Privacy Commissioner of Ontario, and now appears explicitly in GDPR Article 25 ("data protection by design and by default"). PbD's seven foundational principles, slightly paraphrased for the modern reader:
- Proactive not reactive — anticipate privacy issues before they happen, not after a breach.
- Privacy as the default setting — the user gets maximum privacy without lifting a finger. If a feature requires giving up privacy, the user must opt in.
- Privacy embedded into design — not a separate module; an integral part of the architecture.
- Full functionality — positive-sum, not zero-sum — reject the false tradeoff between privacy and other goals.
- End-to-end security — full lifecycle protection — protection from collection through deletion.
- Visibility and transparency — users (and auditors) can see what's happening with their data.
- Respect for user privacy — keep it user-centric — strong defaults, clear notices, user control.
The reason PbD beats bolt-on privacy every time is structural: every privacy retrofit fights the architecture it was added to. A database designed for unbounded retention is a poor host for a deletion API; a query layer that joins everything to everything is a poor host for purpose limitation. The fix has to live in the schema, the API surface, the data flows, the access controls, and the logging — and trying to install it after launch is a multi-year program rather than a sprint.
Privacy Impact Assessment: The Discipline of Asking First¶
Closely paired with privacy by design is the Privacy Impact Assessment (PIA), known under GDPR as a Data Protection Impact Assessment (DPIA). A PIA is a structured analysis that an organization performs before launching a new system, feature, or data-processing activity that is likely to pose a significant privacy risk. The deliverable is a written document, the audience is internal stakeholders and (potentially) regulators, and the value is in the thinking the PIA forces the team to do up front.
A typical PIA walks through these steps:
- Describe the processing. What data is collected, from whom, for what purpose, by what means, with what retention?
- Assess necessity and proportionality. Is each data element actually necessary for the stated purpose, or could the goal be met with less data?
- Identify risks to data subjects. What could go wrong from the user's perspective — re-identification, profiling, discrimination, unauthorized disclosure?
- Evaluate mitigations. What technical and organizational measures reduce each risk — encryption, minimization, access controls, retention limits?
- Consult. Involve the data protection officer, security team, and where appropriate, the data subjects themselves.
- Document and decide. Record the conclusions, the residual risk, and the go/no-go decision. Revisit when material changes occur.
A PIA done early is a $5,000 document; the same questions answered after a breach are a $5 million law firm engagement. The leverage point is timing.
Data Processing Agreements: Contracting the Vendors¶
Modern systems are not built in-house; they are stitched together from cloud providers, SaaS vendors, analytics platforms, and contractors. Each of those is, in privacy terms, a processor acting on behalf of your controller. GDPR (and most modern privacy regimes) require that the relationship be governed by a written Data Processing Agreement (DPA) — a contract specifying what the processor may and may not do with personal data, what security measures it must apply, how it must handle subject requests, where it may transfer data, and what happens at end-of-contract.
DPAs are not exciting reading, but they are the single mechanism by which legal accountability for personal data follows the data into vendor hands. A controller that hands personal data to a processor with no DPA, or a DPA full of vendor-favorable carveouts, has not transferred liability — it has merely added a co-defendant. Mature procurement organizations maintain a standard DPA template, refuse to sign vendor templates without redlining, and keep a register of every DPA in force so that when a regulator asks "who has your customer's data?" the answer takes thirty seconds, not three weeks.
Data Residency, Cross-Border Transfers, and Schrems II¶
Where data physically lives turns out to matter, sometimes a great deal. Data Residency is the requirement (or strong preference) that personal data of a country's residents be stored, and sometimes processed, on servers physically located within that country's borders. Some regulations make residency mandatory (Russia's data localization law, China's Cybersecurity Law); some are softer (a national bank regulator strongly preferring local hosting); some are entirely matters of customer trust (an EU enterprise customer simply preferring an EU region for their tenant).
Cross-Border Transfer is the act of moving personal data from one jurisdiction to another, and under GDPR it is restricted by default. The reasoning is that personal data, once exported, may end up under a legal regime that does not provide the protection GDPR demands. GDPR therefore requires that any transfer of personal data outside the EEA rest on one of a few specific legal mechanisms: an adequacy decision (the European Commission has formally determined that the destination country provides adequate protection — currently a short list including the UK, Switzerland, Japan, South Korea, and a few others), Binding Corporate Rules (for intra-group transfers within multinational corporations), or Standard Contractual Clauses.
Standard Contractual Clauses (SCCs) are template contract terms, drafted by the European Commission, that the data exporter and importer sign to commit themselves to GDPR-equivalent protections regardless of where the data lands. SCCs are the workhorse mechanism: most US-EU data transfers today rest on them. The 2021 modernization of the SCCs added a transfer impact assessment requirement — the parties must analyze whether the destination country's surveillance laws would actually allow the importer to honor the SCCs, and if not, supplement the SCCs with technical measures (e.g., end-to-end encryption with keys held only in the EU).
The reason that transfer impact assessment exists has a name: Schrems II. The case (formally Data Protection Commissioner v. Facebook Ireland and Schrems, decided by the European Court of Justice in July 2020) invalidated the EU-US Privacy Shield framework — the previous adequacy mechanism for US transfers — on the grounds that US surveillance law (specifically Section 702 of FISA and Executive Order 12333) gave US intelligence agencies access to EU residents' data in ways incompatible with GDPR-level protection. The decision threw the trans-Atlantic data economy into a multi-year period of uncertainty, ultimately resolved (for now) by the EU-US Data Privacy Framework adequacy decision in July 2023 — which a third Schrems lawsuit is currently challenging.
The systems-thinking takeaway is that geography is never neutral in privacy architecture. Where you put a database is a legal decision, not just a latency decision. The mature posture is to choose cloud regions deliberately, document the choices, and build the architecture so that re-regionalization (moving the EU tenant to an EU region after a Schrems-III-style decision) is achievable in months, not years.

Heads up
There is a beguiling pattern in cloud architecture where a developer "just spins up" a new analytics workspace in whichever region has the cheapest GPU pricing this quarter, copies a customer-data export into it for "a quick experiment," and forgets about it. Six months later, that workspace contains EU customer data sitting in a US region with no SCCs, no DPA covering the analytics platform, and no entry in the records of processing. This is a textbook footgun: silent (no error fires), easy to trigger (the path of least resistance for any data scientist with a cloud budget), and damaging in delayed and invisible ways (it doesn't surface until a regulator or auditor asks). The structural fix is not "remind people to be careful" — it's tenant-level controls that make non-compliant regions unavailable, plus a data lineage system that flags personal data the moment it crosses a border.
Records Retention: Keep It Long Enough, Not Longer¶
Records Retention is the discipline of defining, for every category of data the organization holds, how long it must be kept and when it must be destroyed. The art lies in the tension between two opposing forces. On the keep-longer side: tax law (most jurisdictions require seven years of financial records), employment law (varies by jurisdiction and record type), industry regulation (HIPAA's six-year requirement for certain records), and litigation hold obligations (when litigation is reasonably anticipated, normal destruction stops). On the destroy-sooner side: GDPR's storage limitation principle (personal data must not be kept longer than necessary), data minimization, the cost of storing and securing data nobody is using, and the rather large risk that a future breach turns ten-year-old data into a ten-year-old liability.
A retention schedule is the operational artifact: a table listing every data category, its retention period, the legal/regulatory basis for the period, and the disposition action at end-of-life (secure deletion, anonymization, archive). Mature organizations bake the retention schedule into the systems themselves so deletion is automatic — a record reaches its retention horizon and the system either deletes it or anonymizes it without human action. The footgun version is the manual retention schedule that exists in a SharePoint document nobody reads while every system retains everything forever.
Anonymization deserves a footnote. True anonymization means the data can no longer be linked back to an individual even with auxiliary information — a high bar, often technically harder than expected, and in many cases unachievable for rich behavioral data. Pseudonymization (replacing direct identifiers with tokens while keeping a re-identification key) is much more common but does not exit the data from GDPR's scope. The vocabulary matters when an auditor asks.
Data Breach Notification: When the Worst Happens¶
When a breach occurs, the law generally requires you to tell people. Data Breach Notification rules are now nearly universal among modern privacy regimes, but they differ in timing, scope, and recipient. GDPR demands notification of the supervisory authority within 72 hours of becoming aware of a breach (with affected individuals notified "without undue delay" if the risk is high). HIPAA's Breach Notification Rule gives covered entities up to 60 days to notify affected individuals and HHS. CCPA/CPRA creates a private right of action that lets affected California residents sue directly for statutory damages. State laws across the US set their own clocks, often 30 to 60 days.

The 72-hour GDPR clock is shorter than most teams' incident-response runbooks anticipate. The implication is that breach detection and triage must be fast enough to make a 72-hour decision possible — which means investing in the security operations capabilities Chapter 14 covers. A breach that nobody noticed for six weeks is also a 72-hour-clock violation; ignorance is not a defense.
The systems-thinking observation: every breach notification creates a feedback loop in the trust relationship between the organization and its users. Public notification raises pressure for governance investment, which (eventually) reduces breach frequency, which (eventually) restores trust. The loop works — but slowly, and only if the organization actually invests after the notification rather than treating the disclosure as the end of the story.
Privacy Engineering: The Career Becomes a Discipline¶
Tying all of this together is the emerging discipline of Privacy Engineering: the application of engineering rigor to the implementation of privacy requirements in software systems. Privacy engineers are the technical specialists who translate "we need to honor the right to erasure" into a cascading deletion API across forty data stores, who design pseudonymization schemes that survive an internal threat model, who build differential-privacy mechanisms into analytics pipelines, who set up tenant-level controls that make cross-border violations structurally impossible.
The discipline has only existed by name for about a decade and is one of the fastest-growing specialties in IS. Job titles include privacy engineer, privacy architect, data protection engineer, and (in larger organizations) chief privacy officer. The skill set is hybrid: deep familiarity with the regulatory regimes in this chapter, comfort with the data-architecture concepts in Chapters 6 through 9, security-engineering literacy from Chapter 14, and the systems-thinking instinct to spot where a privacy requirement implies a data-flow change three layers below the obvious one.
A graduate of this chapter who decides to specialize in privacy engineering is entering a market with structural undersupply, regulatory tailwinds, and the genuine satisfaction of building systems that respect the people who use them. It is one of the most leverage-rich corners of an already leverage-rich field.
Putting It All Together¶
Privacy and compliance are where engineering meets policy, and the IS professional who can speak both fluently becomes the indispensable connector between the legal department and the engineering organization.
- GDPR sets the global tone with lawful basis, purpose limitation, data minimization, consent management, and a portfolio of data subject rights including the operationally formidable right to erasure and data portability.
- CCPA/CPRA brings the US-state model with opt-out-of-sale rights; HIPAA governs healthcare data with its Privacy, Security, and Breach Notification Rules; SOX imposes financial-reporting controls that bring IS systems into audit scope; PCI-DSS is the contractual standard that makes scope-reduction the most leveraged architectural decision in payments.
- Privacy by Design bakes privacy into the architecture from day one; the Privacy Impact Assessment is the discipline of asking the privacy questions before, not after, launch; the Data Processing Agreement is the contract that follows personal data into vendor hands.
- Data residency rules where data lives; cross-border transfers are restricted by default and rest on adequacy decisions, Standard Contractual Clauses, or BCRs; Schrems II is why every SCC-based transfer now needs a transfer impact assessment.
- Records retention schedules balance keep-longer obligations against destroy-sooner principles; data breach notification rules impose tight clocks (72 hours under GDPR) that force investment in detection and response; privacy engineering is the emerging discipline that turns all of these requirements into running code.
A graduate of this chapter walking into their first compliance conversation should be able to ask, in order: Which regimes apply here? What is our lawful basis? Have we minimized? Where does this data live and where might it travel? Do we have DPAs with every processor? What does our retention schedule say? Can we honor an erasure request end-to-end? Have we done a PIA? What is our 72-hour breach response plan? Asking those nine questions confidently in a meeting is most of the way to being the person the room turns to when a regulator's letter arrives.
